CINCINNATI (WLW) — A U. S. District Court judge has ordered a temporary restraining order against the drug maker, Pfizer Inc., which is facing legal action in a lawsuit filed by a class of about 1,500 people who have allegedly been accused of importing drugs, misbranding, and selling fake drugs.
The order is intended to prevent the pharmaceutical company from obtaining a trademark or copyright from Pfizer, as well as from launching a class action lawsuit that claims the company “has not properly marketed or marketed the product” when it launched the product, according to a statement by the District Court.
The suit was filed Friday by the Class of 1,000 people who are alleged to have been buying, using, and selling fake Viagra in the United States, the District Court announced.
The lawsuit alleges that Pfizer’s drug product, the drug product Pfizer Inc. sold in the U. market in October 2010, had a substantial impact on the market, in the form of a generic product named Vardenafil, as well as on consumers’ health care expenses.
According to the lawsuit, Pfizer’s patent for the generic drug “is not limited to the U. market.”
Pfizer filed the case on Friday, seeking to halt the defendant’s conduct and for the return of damages.
The court said it would not order Pfizer to pay any damages to the Class of 1,000 people, who claim the drugmaker’s marketing and sales of the product were tainted with false claims, false representations, and misleading statements.
The case comes shortly after Pfizer’s recent settlement with its patent attorney, Vardenafil, and in October 2011, the class of 1,000 members filed a class action against Pfizer. A lawsuit has already been filed against the class. The suit seeks damages from the class and an award of punitive damages.
Pfizer, which makes Vardenafil, is facing federal criminal liability for the unlawful marketing and sale of the product by U. Food and Drug Administration (FDA) in connection with the company’s 2011 recall of its generic drug, Viagra.
The FDA approved the drug for recreational use in the United States in July 2010. It is sold under several brand names, including Cialis, Levitra, and Staxyn.
